Welcome to Buy-it.ai ("Service"), operated by Buy-it Corp. ("Company", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of https://buy-it.ai. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Overview
Buy-it.ai uses artificial intelligence to identify products seen in video content and provide links to third-party retailers via affiliate partnerships. We do not sell products directly. All purchases are made on third-party retailer websites and are governed by those retailers' own terms and policies.
2. Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these requirements.
3. Use of Service
You agree to use the Service:
Only for lawful purposes and in compliance with all applicable laws
Without disrupting, interfering with, or impairing others' access to the Service
Without attempting to reverse engineer, decompile, disassemble, or otherwise derive the source code of any part of the Service
Without using automated tools (bots, scrapers, crawlers) to access the Service without our prior written consent
Without circumventing any security measures or access controls
Without impersonating any person or entity
We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including removing content and terminating access.
4. AI-Powered Product Identification
a) Nature of AI Recommendations
The Service uses artificial intelligence to identify products in video content. AI-generated product identifications are provided "as-is" for informational purposes only and:
May contain errors, including incorrect product matches, wrong colors, sizes, or variants
May reference products that are discontinued, out of stock, or no longer available
Do not constitute endorsements, warranties, or guarantees of product quality, suitability, or fitness for a particular purpose
Are generated algorithmically, not through human editorial selection or paid product placement
b) Pricing and Availability
Product prices displayed on the Service are approximate and provided for reference only. Actual pricing, availability, and shipping terms are determined solely by the third-party retailer at the time of your purchase. We are not responsible for any discrepancies between prices shown on the Service and prices charged by retailers.
c) No Liability for AI Recommendations
You acknowledge that you use AI-generated product recommendations at your own risk. Buy-it Corp. shall not be liable for any loss, damage, or expense arising from your reliance on AI-generated product identifications or recommendations.
5. Affiliate Links & Earnings
Buy-it.ai participates in affiliate marketing programs, including the Amazon Associates Program and other retail affiliate partnerships. We earn commissions on qualifying purchases made through affiliate links on the Service. This affiliate relationship does not affect the price you pay.

6. Intellectual Property
a) Our Content
All content, logos, trademarks, technology, software, and other intellectual property used on Buy-it.ai are owned by Buy-it Corp. or licensed to us. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.
b) Third-Party Content
Video content, product images, brand logos, and other third-party materials displayed on the Service are the property of their respective owners. Our use of such content for product identification purposes is transformative in nature.
c) User Content
If you submit, post, or otherwise provide content to the Service (including through contact forms, feedback, or account features), you grant Buy-it Corp. a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, and display such content solely in connection with operating and improving the Service. You represent that you have the right to grant this license for any content you provide.
7. Copyright Infringement (DMCA)
We respect the intellectual property rights of others. If you believe that content on the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our Designated Copyright Agent:

Repeat Infringer Policy
We maintain a policy of terminating the accounts or access of users who are repeat infringers of copyright in appropriate circumstances.
Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification to the Designated Copyright Agent with the information required under 17 U.S.C. 512(g).
8. Disclaimers and No Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
The Service will be uninterrupted, secure, or error-free
AI product identifications will be accurate, complete, or current
Product availability, pricing, or descriptions will be accurate
Any defects in the Service will be corrected
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BUY-IT CORP. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO:
YOUR USE OF OR INABILITY TO USE THE SERVICE
ANY AI-GENERATED PRODUCT RECOMMENDATIONS OR IDENTIFICATIONS
ANY PURCHASES MADE THROUGH AFFILIATE LINKS
ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
ANY THIRD-PARTY CONDUCT ON THE SERVICE
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID TO US IN THE PRECEDING 12 MONTHS, WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
10. Indemnification
You agree to indemnify, defend, and hold harmless Buy-it Corp., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
Your use of the Service
Your violation of these Terms
Your violation of any applicable law or regulation
Any content you submit to the Service
Your infringement of any third-party intellectual property or other rights
11. Dispute Resolution
a) Informal Resolution
Before initiating any formal dispute proceeding, you agree to first contact us at support@buy-it.ai to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.
b) Binding Arbitration
If the dispute is not resolved informally, you and Buy-it Corp. agree to resolve any dispute, claim, or controversy arising from or relating to these Terms or the Service through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration will be conducted in Bexar County, Texas, or at another mutually agreed location
The arbitrator's decision shall be final and binding
Judgment on the arbitrator's award may be entered in any court of competent jurisdiction
c) Class Action Waiver
YOU AND BUY-IT CORP. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
d) Opt-Out Right
You may opt out of this arbitration agreement by sending written notice to support@buy-it.ai within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
e) Small Claims Exception
Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in Bexar County, Texas.
13. Termination
We reserve the right to suspend or terminate your access to the Service at any time, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service immediately ceases.
Provisions that by their nature should survive termination shall survive, including but not limited to: Sections 6 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), 11 (Dispute Resolution), and 12 (Governing Law).
14. Changes to These Terms
We may modify these Terms at any time. Material changes will take effect 30 days after posting the updated Terms on this page with a revised effective date. Your continued use of the Service after that period constitutes acceptance of the updated Terms.
If you do not agree to the modified Terms, you must stop using the Service before the changes take effect.
15. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy and Affiliate Disclaimer, constitute the entire agreement between you and Buy-it Corp. regarding the Service.
